We reserve the right to modify these Terms at any time without prior individual notice. Changes become effective immediately upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the revised Terms. The “Last Updated” date at the bottom of this page indicates when changes were made.

Material changes (those affecting your legal rights or obligations) will be highlighted on our homepage for at least 14 days. For existing orders, the Terms in effect at the time of purchase apply.

2. Eligibility & Account Responsibilities

You must be at least 18 years old to create an account or make a purchase on our Site. By using our Site, you represent and warrant that you meet this age requirement.

2.2 Account Creation (Optional)

You may browse our Site without creating an account. However, an account is required to:

  • Save payment methods

  • Track order history

  • Save shipping addresses

  • Receive loyalty benefits (if offered in the future)

Account Security: If you create an account, you are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to:

  • Notify us immediately of any unauthorized use of your account

  • Ensure you log out of your account after each session (especially on shared devices)

  • Provide accurate, current, and complete information during registration

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

3. Products & Pricing

3.1 Product Descriptions

We strive to display our products as accurately as possible through images, descriptions, and specifications. However:

Color variations: Due to differences in computer, tablet, and phone screens (brightness, contrast, color calibration), the actual product colors may vary slightly from what you see on your screen. We cannot guarantee that your monitor’s display of any color is exactly accurate.

Hand-etched variations: Our products are handcrafted or individually etched. Minor variations in etching depth, placement, or appearance are normal and contribute to each product’s unique character. These variations do not constitute defects.

Size and dimensions: All measurements are approximate and may vary by up to 5% due to manufacturing tolerances.

Typographical errors: In the event a product is listed at an incorrect price or with incorrect information due to typographical error, we reserve the right to refuse, cancel, or limit any orders placed for that product, even after order confirmation or payment processing.

3.2 Pricing

All prices are listed in United States Dollars (USD) and are exclusive of:

  • Shipping and handling fees (calculated at checkout)

  • Applicable sales taxes (calculated based on shipping address)

  • Customs duties, import fees, or VAT for international orders (customer responsibility)

Price changes: We reserve the right to adjust prices at any time without prior notice. Price changes do not affect orders already placed and confirmed.

Price matching: We offer a limited price match guarantee (see Section 4.6 of our About Us page). Contact joymade.bachwl@gmail.com with proof of lower price from a legitimate competitor.

3.3 Product Availability

All products displayed on our Site are subject to availability. We do not guarantee that any product will be in stock at the time you place your order.

Backorders: If a product is out of stock, you may be given the option to place a backorder. Backordered items will ship when available (estimated lead time provided). You may cancel a backorder at any time before shipment for a full refund.

Limited editions: Some products are released as limited editions or seasonal collections. Once sold out, they may not be restocked.

3.4 Right To Limit Quantities

We reserve the right to limit the quantity of products per person, per household, or per order. This includes the right to cancel orders that appear to be for resale (bulk purchases without wholesale authorization). 4. Orders & Payment

4.1 Order Acceptance

When you place an order on joymade.shop, you will receive an automated email confirming receipt of your order. This email does not constitute acceptance of your order – it is only confirmation that we have received it.

Order acceptance occurs when we:

  • Process your payment successfully through Stripe, and

  • Begin preparing your order for shipment

We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability

  • Suspected fraud or unauthorized transaction

  • Pricing errors

  • Shipping address cannot be verified

  • Violation of these Terms

If we cancel your order after payment, we will issue a full refund to your original payment method.

4.2 Payment Processing

All payments are processed securely through Stripe. By placing an order, you authorize us to charge your selected payment method for the total order amount (including taxes and shipping).

Payment methods accepted:

  • Credit cards (Visa, Mastercard, American Express, Discover, JCB, UnionPay)

  • Debit cards (with Visa/Mastercard/Amex/Discover logo)

  • Apple Pay

  • Google Pay

We do not store full credit card numbers on our servers. Stripe handles all sensitive payment data through tokenization.

4.3 Billing Information

You agree to provide current, complete, and accurate billing information. You authorize us to update any expired or changed payment information if your bank provides it through Stripe’s card updater service.

Failed payments: If your payment is declined, your order will not be processed. You will be notified and given the opportunity to provide alternative payment.

4.4 Order Modifications & Cancellations

Before shipment: You may modify or cancel your order within 2 hours of placement by emailing joymade.bachwl@gmail.com with “MODIFY” or “CANCEL” in the subject line. After 2 hours or once processing has begun, modifications may not be possible.

After shipment: Once shipped, the order cannot be modified or canceled. Please follow our Return Policy after receiving the items.

5. Shipping & Delivery

5.1 Shipping Policy

Our complete Shipping Policy is available separately and incorporated into these Terms by reference. Key provisions:

  • Processing time: 1-3 business days (custom items 3-7 business days)

  • US delivery: 3-7 business days after shipment

  • International delivery: 10-20 business days after shipment

  • Shipping costs: Calculated at checkout based on weight and destination

5.2 Risk Of Loss

All products purchased from JOYMADE are made pursuant to a shipment contract. This means that title and risk of loss pass to you when the carrier takes possession of your package (i.e., when we hand it to USPS, UPS, FedEx, or international carrier).

What this means for you: If your package is lost or damaged after the carrier has it, you may need to file a claim with the carrier. However, as a courtesy, we will assist you with tracking and can reship or refund if we determine the loss is our responsibility (e.g., we used the wrong address).

5.3 Delivery Estimates

Any delivery dates provided (at checkout, in shipping confirmation, or elsewhere) are estimates only, not guarantees. We are not liable for delays caused by:

  • Weather conditions

  • Carrier strikes or service interruptions

  • Customs delays for international shipments

  • Incorrect address provided by you

  • Force majeure events (see Section 12)

5.4 International Shipping

Customs, duties, and taxes: You are solely responsible for any customs duties, import taxes, VAT, or other fees imposed by your country’s government. These are not included in the price you pay on joymade.shop.

Customs delays: Packages may be held for inspection or duty assessment. We have no control over these delays.

Prohibited items: Some countries restrict certain products. It is your responsibility to ensure our products can be legally imported into your country. If customs seizes your package, we are not obligated to refund or replace.

6. Returns & Refunds

Our complete Refund and Return Policy is available separately and incorporated into these Terms by reference. Key terms:

  • 30-day return window for most products (extended for holidays)

  • Customer pays return shipping unless return is due to our error

  • Custom/personalized items are non-returnable unless defective

  • Damaged items require notification within 30 days with photos

By purchasing from JOYMADE, you agree to comply with our Return Policy.

7. Intellectual Property

7.1 Our Ownership

All content on joymade.shop – including but not limited to:

  • Product designs, etchings, and artwork

  • Text, descriptions, and blog posts

  • Logos, trademarks, and trade dress (including “TALES ETCHED BY JOYMADE” and the JOYMADE logo)

  • Images, photographs, and videos

  • Website code, layout, and design elements

is the exclusive property of TALES ETCHED BY JOYMADE LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

7.2 License To Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Site for personal, non-commercial purposes. This license does not permit:

  • Copying, reproducing, or distributing any content without written permission

  • Using our designs or artwork to create knockoff products

  • Framing or mirroring our Site

  • Scraping product data for commercial use

7.3 Trademarks

“JOYMADE,” “TALES ETCHED BY JOYMADE,” and all related logos are registered or pending trademarks. You may not use these marks without our prior written consent.

7.4 Custom Orders – License Grant

When you submit a design, text, or image for a custom/personalized product, you grant JOYMADE a non-exclusive, worldwide, royalty-free license to:

  • Reproduce your design onto the product you ordered

  • Use photos of the finished product (with your personal information removed) for marketing purposes

You represent and warrant that you own or have permission to use any design you submit. We reserve the right to refuse to produce any custom order that:

  • Infringes on third-party intellectual property

  • Contains offensive, hateful, or illegal content

  • Depicts copyrighted characters without permission (e.g., Disney, Marvel, sports logos)

7.5 Copyright Infringement Claims (DMCA)

If you believe content on our Site infringes your copyright, please submit a DMCA takedown notice to joymade.bachwl@gmail.com including:

  • Identification of the copyrighted work claimed to be infringed

  • Identification of the material claimed to be infringing (URL or description)

  • Your contact information

  • A statement of good faith belief that use is not authorized

  • A statement under penalty of perjury that your notice is accurate

  • Your physical or electronic signature

8. User Conduct & Prohibited Activities

8.1 Permitted Use

You agree to use our Site only for lawful purposes and in accordance with these Terms.

8.2 Prohibited Activities

You may NOT:

8.3 Consequences Of Violation

Violation of these prohibitions may result in:

  • Immediate account suspension or termination

  • Cancellation of pending orders without refund

  • Reporting to law enforcement or credit card fraud databases

  • Civil or criminal liability

9. Warranty Disclaimer & Limitation Of Liability

9.1 “As-Is” Disclaimer

EXCEPT AS EXPRESSLY PROVIDED IN OUR RETURN POLICY, ALL PRODUCTS AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, JOYMADE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Implied warranties of merchantability (that products are fit for ordinary purposes)

  • Implied warranties of fitness for a particular purpose (that a mug will be perfect for your specific need)

  • Warranties of non-infringement

  • Warranties arising from course of dealing or usage of trade

What this means: While we stand behind our quality and offer refunds for defects, we do not guarantee that products will never show wear, that colors will perfectly match your screen, or that delivery will never be delayed by carriers.

9.2 Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYMADE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities

  • Loss of data

  • Personal injury or property damage arising from product use (e.g., hot coffee spill)

  • Cost of substitute products or services

  • Any other damages not directly caused by our breach of these Terms

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO JOYMADE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Example: If you bought a 20mugthatcrackedafternormaluse,themaximumyoucouldrecover(evenifyousued)is20 – not compensation for spilled coffee, stained carpet, or lost time.

9.3 State Law Variations

Some states (including California, New York, Texas) do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such states, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless TALES ETCHED BY JOYMADE LLC and its officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms

  • Your violation of any third-party rights (including intellectual property or privacy rights)

  • Any misuse of our Site or products

  • Any fraudulent or illegal activity conducted through your account

What this means: If JOYMADE gets sued because of something you did (like submitting a design that infringes someone’s trademark), you pay our legal fees and any settlement or judgment.

11. Privacy & Data Use

Our Privacy Policy (available separately) governs how we collect, use, and protect your personal information. By using our Site, you consent to our data practices as described in the Privacy Policy.

12. Force Majeure

Neither party shall be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, wildfires)

  • War, terrorism, or civil unrest

  • Pandemics, epidemics, or public health emergencies

  • Government actions, sanctions, or embargoes

  • Labor strikes or supply chain disruptions

  • Internet or utility failures

If a force majeure event occurs, our performance obligations (including shipping deadlines) are suspended for the duration of the event. We will notify you as soon as reasonably possible.

13. Dispute Resolution & Governing Law

13.1 Governing Law

These Terms and any dispute arising from them or your purchase of JOYMADE products shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Important: This means Wyoming law applies even if you live in another state or country.

13.2 Informal Resolution

Before filing any legal action, you agree to contact us at joymade.bachwl@gmail.com to attempt to resolve the dispute informally. We will work with you in good faith to find a mutually acceptable resolution.

13.3 Binding Arbitration

IF INFORMAL RESOLUTION FAILS, YOU AND JOYMADE AGREE TO RESOLVE ANY DISPUTE THROUGH BINDING INDIVIDUAL ARBITRATION, NOT IN COURT. This agreement to arbitrate applies to all claims, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.

Exceptions: Either party may bring an individual action in small claims court (if the claim qualifies) or seek injunctive relief for intellectual property infringement.

Arbitration rules:

  • Administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules

  • Conducted in Sheridan, Wyoming (or virtually if you prefer)

  • Arbitration will be before a single neutral arbitrator

  • Each party bears its own costs (JOYMADE will cover arbitration fees up to $5,000)

  • No class actions or consolidated claims – you may only bring claims in your individual capacity

YOU ARE GIVING UP YOUR RIGHT TO GO TO COURT AND YOUR RIGHT TO A JURY TRIAL. You are also giving up the right to participate in a class action lawsuit or class-wide arbitration.

13.4 Opt-Out Of Arbitration

You may opt out of this arbitration agreement within 30 days of your first purchase from JOYMADE by emailing joymade.bachwl@gmail.com with your full name, address, and a clear statement that you opt out. If you opt out, both parties retain the right to sue in court.

14. Severability & Entire Agreement

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and TALES ETCHED BY JOYMADE LLC regarding your use of our Site and purchase of our products. They supersede any prior agreements, representations, or understandings.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
